my girlfriend worked a few days as a trail guide for a local barn. they did not have her fill out a w4 form, and paid her in cash last week. This week, she was let go, and she questioned them about workmans comp and w4 form(if she were to get injured she would not be covered,etc)

now they are holding her pay until she fills out a w4 trying, either trying to screw her, cover their ass, or both.

Is this legal?

I think a w2 and w4 is not required for casual labor. The threshold used to be $400. a year, I think.

thanks, she says she's not even going to bother with it. why should she? I pay the bills :1rotflmao

She also wouldn't be eligible for unemployment after working only a few days of casual work.

Workmens Comp would vary by state. If she was injured on the job as a casual laborer, she may have been covered under the owner's own property/liability insurance.
