If you "do ebay" as a career, the fact that offending auctions can get pulled, and even your activities suspended, should be enough to keep you on the straight and narrow. In turn, staying on the straight and narrow would keep reporting of your auctions to a minimum. Personally, I have always been thanked for my reports, and no one has ever said NOT to report what I saw as a violation.

Bliss- I have followed your efforts over the years in being a "cyber cop" with regard to eBay violations and scams over the years. I personally think that your efforts are to be admired and I respect what you've done. I do some things behind the scenes and do what I can for folks outside the boards, but probably not at the extent you do.

What I am having trouble with is the fact that heavy, along with many others, seem to think that making photocopies of copyrighted published automobile service literature is OK. Not only is it illegal, but it is unethical. It violates copyright laws and it violates eBay's TOS.

And yet somehow because heavy is on the side of disliking chops and nuke because he feels they are the ones responsible for reporting him and causing him some grief in that regard, he is "welcomed" as part of the "Auction Watch" group on that basis alone, while you should be disgusted with his violations in the same manner as you are disgusted at other scammers.

The very title, "Auction Watch" should indicate that the MAIN focus of the board was based upon integrity in auctions. Sellers have an obligation to follow law and follow eBay guidelines in their listings, and when anyone from any camp sees such violations, they should report them to the proper people using the proper channels.

Banjo - I can only proclaim what I know about ebay's policy on copyright when in violation of using another member's images and text. I know this, as I have had to employ it a few times with some of my royal mint material. I can remember when I was in school and would be studying at the public library with a mountain of books on my table. Back then, I would have the librarian photocopy any pages from any book I didn't want to take home with me and it was done freely.

Bliss- There is a huge difference between a school student going to a library and making a photo of something so that he can referece the material and have it for a research paper and a person who is knowingly and intentionally making photos of copyrighted materials FOR PROFIT.

We all have been through the efforts to shut down scammers who are powersellers, because we all are aware of the fact that eBay often "overlooks" such violations because if they enforce their own policies, they would cut themselves off from a great source of income.

The comment somewhere was made, supposedly in support that eBay doesn't see a problem with this guy's auctions, was something to the affect of "if it doesn't look like duck, doesn't swim like a duck, and doesn't quack like a duck, then it must not be a duck." On the contrary, this person's auctions look, swim, quack, and smell exactly like a duck. EBay simply has chosen to ignore this duck that lays their golden egg.

All I can say is that somewhere down the way, one reaps what they plant. The publishers of the material that heavy seems to feel is his own to copy, sell, and profit from are probably at this very moment building a legal case against him, and I wouldn't want to be in his shoes when the petitions are filed and the warrants served.

While he may feel he is immune from eBay, publishers are a bit more bullish in their efforts to prosecute copyright infringement.

Over that time I've seen the good efforts of a lot of folks trying their best to rid eBay of scammers, most of which don't even frequent chat sites. While you have a habit of calling these people "self-appointed", they are simply doing their duty to help eBay be a better and safer place in which to trade.

You seem to focus in on Chops and Nuke, but it is most likely after reviewing your negs and neutrals, that you have been reported over a period of time by lots of different people. I'm pretty certain the publishers are aware of your antics by now, and like I said before, I wouldn't want to be in your shoes when the papers are served.

EBay loves you because you are making them money. They often have a record of looking the other way, but copyright infringement is a different matter and involves people who have money being taken out of their pocket rather than the other way around.

It's amusing in a way to see you rant and rave about some people who have at least exposed you for what you are doing, and in turn you get your thrills out of the doctoring of photos. While you think the T&Sers are self appointed cyber cops, I've seen them put a lot of scammers out to pasture.

Take shilling for example...why did Bliss have to make a report about shilling concerning the auction in the subject of this thread in the first place? EBay should know bidders who are linked to other accounts and have the full capability to identify them if they should bid on linked accounts. However, they routinely "ignore" such things because it drives the price of the item up and eBay benefits in the form of FVF's. While this single auction may have been shut down (and only after being reported, by the way), those of powersellers are sometimes next to impossible to shut down.

Scammers often last a long time, unhinded by the very auction site that allows and overlooks their actions until outside agencies such as VERO affiliated companies, the FTC, or law enforcement become involved. And they only become involved after people who have been victims of abuse have reported, reported, and reported.

IF eBay continues these practices of overlooking violations, it could very well be the straw that breaks the camel's back. Only time will tell...

Thank you, Banjo. You are correct. One of the legal requirements for a cease and desist order is that exact examples be given of previous harassment. None were, because there has been no harassment by me towards Mr. Cartman. I can, however, show several examples of continued harassment, in this very thread alone, besides the faxed proof.

Perhaps I did stop being her friend after months (going back to last Fall) of getting less than cordial EZmails. When she blocked me from replying to her latest EZmail barbs that was what tipped me over from the friend category into the former friend category. It was a fooish act in wich caused folks not invoved in the boards; time and money.

As I said before where, does cartman derive his authority to order anyone to stop using or posting to him on those semi-public boards. Carmtan informed your employer that further legal action might be necessary as well as informing them that failing to comply with his order was against the law. He made his document a legal instrument based upon words like stalking that he didn't understand the full legal meaning. I can also see how and why a reader of his poorly formatted C& D order might get the impression that those websites were enjoined to his C&D order.
