View Full Version : POLONSKY IMPLICATED IN FRAUD SCHEME!!!

CENTRALIA, MO (cartBay) – New information coming in from Centralia, Missouri seems to link bit-actor Alan Polonsky in the plot by Karl Kischkel to defraud investors in his so-called opal business.
Kischkel reportedly used Mr. Polonsky’s name as an enticement to lure potential investors into giving him money and to defraud local businessmen out of goods and services. Karl Kischkel apparently led potential investors to believe that Polonsky had committed to investing up to $50,000 in the phantom business.
It is believed that Polonsky was instrumental in procuring Kischkel’s now famous “Beverly Hills” front address and questions remain about the extent of Polonsky’s participation in this scheme and whether or not he was a willing participant in Kischkel’s other fraudulent activities.
Kischkel’s former landlord, Carl Henderson, says that in his entire life as a successful businessman in the community, he had “never met a bigger con than Karl”!
Kischkel kept promising his landlord that he would get “caught up” on his rent when “his ship came in”, though no payments were ever made. Henderson said that he had “had enough” when a local newspaper article about Kischkel was published and rumors began circulating about “Hollywood” investors giving Kischkel tens of thousands of dollars. Henderson found this strange since he hadn’t seen a single dime. When confronted, Kischkel claimed that he was forced to give his ex-wife $40,000 and that the rest of the money was “tied up”.
Henderson didn’t believe any of Kischkel’s stories anymore and filed papers to move forward with the eviction. On October 26,2005 Henderson physically helped Kischkel move from his rental unit.
Kischkel’s final words to his former landlord were “send me an invoice and I’ll pay it”, though as of this day he has failed to do so.
A short time after Kischkel was evicted, the local utility contacted Henderson seeking information on Kischkel’s new address, which Henderson willingly provided. It seems that Kischkel had given the utility a bogus forwarding address and they were unable to send him his final electric bill.
Also under scrutiny at this time is one James Smith, a writer for the local a paper that recently wrote a flattering article about Kischkel’s supposed “business”. The article now seems to have been written solely based on Kischkel’s accounts with no corroboration or independent reporting done on the story at all. Mr. Smith is also evidently a friend of Kischkel. The paper is reportedly conducting an internal investigation of the matter.
As previously reported; Kischkel is now working as a maintenance man at an apartment complex in exchange for free or reduced rent. The owner of this new property seems to be somehow related to the newspaper that wrote the false story about Kischkel.
Both Karl Kischkel & Alan Polonsky have refused to comment on these events.

Can I conclude that a business person who confirms "there is a seasonal demand for opals (http://www.therossshow.com/showthread.php?t=3930)" is merely making a fabricated statement to obtain a business agreement (written or oral) from an intended partner?

I hate to be judgemental (no, really I do), but to not label the original post as satire is a bit careless and wrong.
Not everyone who reads here knows all the creepy obsessive ins and outs of the soap opera.
I take it back - I don't hate being judgemental. If we don't learn to make judgements, we end up living lives w/no social, moral, or ethical definitions and boundaries.
Peace.

It is not satire!
All the events happened - all of the people in my article are real and they all really did say the things that I quoted them as saying.
On his own board, Polonsky corrected one minor error (as he saw it) but did not refute or deny any of the underlying facts of this story.

He was terminated for "credit card fraud, embezzlement and misrepersintation"? This cannot be true. This isn't the Karl who I know. His name must be hijacked? *shrug*
Are you the Dennis mentioned in that photo/scan?

Cart, such serious allegations s/b substantiated. If they're not, then this isn't any different than the twisted lies spread by Alan after Wasa passed.
In my experience Karl is a bum, braggart, bullying blowhard, & lying fool. Evidence suggests he's physically abusive, as well. He might be a scamming crook too. It wouldn't take much of a stretch, frankly. HOWEVER, documentation supporting such accusations is needed IMEO.
Assuming that Karl is a thieving fraud, what evidence suggests that Alan was also a scammer, rather than another victim(albeit a monumentally STUPID victim)? I realize Alan's 'participation' was *questioned* rather than asserted, but it's certainly implied that it's likely he's been a willing participant in the purported scheming.
I suspect you can substantiate your allegations concerning Karl. If so, it s/b an interesting read. Please share.

Polonsky is implicated by his financial investment (admitted) in the scheme and by his actions ... namely by allowing Kischkel to use his name and his status as a "Hollywood actor" (not denied) which allowed Kischkel to defraud others.
Polonsky knows full well that Kischkel was terminated from his job at the pawn shop for misappropriation of funds (stealing). He further knew full well that Kischkel continued to use his former employer's credit card surreptitiously even after he was fired ... yet Polonsky told no one and said nothing.
Whether he actively participated, as opposed to simply turning a blind eye to the illegal activities, is the major question that still needs answering.
... meanwhile, it appears that life goes on in Centralia.

Hello Alan:
I see that you have aligned yourself with Karl's cause and that you
evidently believe the pair of you have some basis for bringing a cause
of action against me pursuant to an "agreement" that never existed.
Let me just bring you up to date on a number of facts:
(1) Prior to our first telephone conversation, which occurred on
September 1 and which Karl presumably had arranged at your request,
Karl and I had been discussing since July possible arrangements under
which he could provide PriceGems with a steady supply of quality,
calibrated precious opals which we needed for our diamond ring
settings. Any subsequent discussion pertaining to any possible
business arrangement involving the three of us was always predicated
upon this original understanding, for otherwise we had no reason to
work with Karl. This is what we were to receive from an arrangement
with Karl, but we never even came close to receiving any calibrated
stones, and it has been clear for some time now that Karl is incapable
of producing them. During our initial conference calls I explained to
both of you why having an interest in our opal supplier made business
sense to us, as I believed this would insure the steady supply of
stones we required, and at a fair price. When Karl complained that
this seemed unfair to him, since we would profit twice, first as a
member of the proposed business entity, and second as the reseller, I
explained that this was both natural and fair, but Karl did not appear
to acquiesce until after you took the point and explained that as an
LLC member I should have the right to earn a profit, and also as a
customer I should also have the right to earn a profit on the products
I sell. I began to doubt Karl's business sense at this time.
Later on, Karl reneged on our original understanding by refusing to
provide PriceGems with calibrated stones before any agreement could be
finalized and signed. In July and August, Karl was quite happy to be
an opal cutter and to have a customer with a standing order for all the
opals he could produce, or so it seemed. After the fluff article about
him was printed in Boone County, however, he suddenly became an
"Artiste" and was too good to simply cut and supply opals to PriceGems,
even though this had been the whole idea from the very beginning. I
find it simply amazing that you and he could even imagine that I would
proceed with this proposed deal when during this entire time Karl could
only produce a single calibrated stone, which did not even remotely
meet our clearly stated specifications and for which he attempted to
charge me far above retail. Since I could not use the opal for the
intended customer, I returned it to Karl and wrote him the September
21 email message entitled "Show me the fire," which I copied to you
some days later. I lost a $3500 sale as a result of Karl's ineptitude,
but Karl didn't care about that. In fact, he simply became angry when
I criticized his incompetence, and he never supplied me with another
calibrated stone thereafter.
(2) I believed Karl's version concerning his dealings with Dennis
Roberts, as you did, but I began to have doubts when Karl called
frantically to request my help in halting the autopay on his
Stone-of-fire.com webhosting account, which Karl had set up
with GoDaddy through Devala.com, because Karl explained during that
episode that the credit card he had used to set up the
Stone-of-Fire.com hosting account belonged to Dennis Roberts. At the
time, I wondered why Mr. Roberts' credit card was being used to pay for
Stone of Fire if Stone of Fire belonged to Karl, and Karl no longer
worked for him. Later on, I began to wonder if the equipment and other
assets Karl had offered as his share to capitalize Stone of Fire were
the property of Mr. Roberts also. Now it appears that Mr. Roberts is
alleging this to be the case.
According to Karl's unratified proposal, Karl was not only to produce
finished opals, and furnish his vaunted expertise, connections, and
accountability, along with $3000 worth of opal rough and equipment, the
existence or value of which was never verified by any means, he also
was to provide 100% ownership interest in Stone of Fire and
stone-of-fire.com, but evidently, there remains a cloud over the legal
ownership of Stone of Fire. I paid for the registration of
stone-of-fire.com without reimbursement, not Karl, and now Dennis
Roberts claims that all of the funds used by Karl in developing that
entity actually belonged to him and were embezzled by Karl. In fact,
he now claims 100% ownership interest in Stone of Fire and presumably
in the assets Karl has since represented as belonging to
himself. According to Dennis Roberts, after Karl was terminated, Karl
began telling a wild story around Centralia that Dennis Roberts had
bought out his "jewelry business" for $50,000.
(3) Karl has not provided any evidence whatsoever concerning his
credentials, which I relied upon in good faith when entering into our
discussions. Mr. Roberts has indicated to me that he too did rely in
good faith upon Karl's representations concerning his gemological
credentials and other qualifications when hiring him, as these were
essential to the position for which Karl had applied. However, after
working closely with Karl in a jewelry store environment, Mr. Roberts
now declares that Karl's credentials are nonexistent, which matches my
own experience and that of others who have accepted Karl on the basis
of his bold claims, only to find him severely lacking when put to the
test. Mr. Roberts states that Karl was "terminated for[sic] credit
card fraud, embezzlement, and misrepresentation," and he said that Karl
had been evicted by his landlord.
While working in the employ of Mr. Roberts, Karl often signed his email
messages as follows:
Karl Kischkel, GD GIA
E-Commerce Manager
Advantage Jewelry & Loan
620 N. Allen
Centralia MO, 65240
573-682-5858
Karl also has made public statements on eBay and elsewhere, such as the
following: "...my qualifications concerning jewelry. Karl K. GD, GC
GIA aka 'Nuke''". Karl has told me that he holds a Bachelor's degree
in Chemical Engineering and a GG degree from the Gemological Institute
of America, in addition to several other certificates, degrees, and
memberships in professional associations.
Karl "Nuke" Kischkel told us that he was a master opal cutter, a master
goldsmith, a master jeweler, and that he was able to easily supply us
with any quantity of the calibrated opals we needed. In addition to
opals, Karl indicated that he could cut cats eye, onyx, and other
stones, such as ruby and sapphire. In fact, anything but diamond. He
represented to me that he could create virtually anything - brooches,
earrings, rings, pins - and, in his own words, to the standard of
"tiffany quality." In the newspaper article Karl concocted with James
Smith, he claims to have cast rings that he wears, but Mr. Roberts
insists that these rings were not made by Karl but rather came from
Advantage Jewelry & Loan, that Karl doesn't know anything about
goldsmithing, and that he was unable even to size rings when asked to
do so. Clearly, nothing Karl has produced to date in the form of a
finished piece comes anywhere near Tiffany quality, and there is no
evidence to indicate that Karl can produce any finished pieces other
than products of the rudimentary wire wrap work he does. Dennis
Roberts states that he told Karl that he didn't like the wire wrap,
that he thought it was inferior, and that no one would buy it.

(4) According to Mr. Carl Henderson, Karl's rent was being paid to him
directly by Karl's employer, Dennis Roberts, and that the rent stopped
after Karl was terminated from his employment around February of this
year. He said that Karl did not pay rent since that time, and that the
amount of unpaid rent accrued by the end of October, when he personally
assisted Karl in vacating the premises, was approximately $5000.
According to Mr. Henderson, Karl told him that he had obtained an
infusion from his investor in Los Angeles in the amount of $50,000;
however, when Karl was asked to pay what he owed out of this amount,
Karl explained that he had already paid a $40,000 lump-sum settlement
to his ex-wife and that the remaining $10,000 already was allocated.
Mr. Henderson said that at this point Karl told him to submit an
invoice, and he would pay it. Instead, Mr. Henderson began eviction
proceedings to collect the outstanding balance.
Mr. Henderson said that he allowed Karl to work off a portion of what
he owed, leaving a balance of approximately $2000. Mr. Henderson
subsequently obtained a judgment against Karl for this amount, which
was recorded earlier this month. Prior to vacating the premises in
late October, Karl showed Mr. Henderson a loose finished opal,
suggesting that he might accept this in lieu of the remaining portion
of the debt owingKarl claimed the stone had a value of $4000, but Mr.
Henderson demonstrated no interest. Now, if this is an accurate
account then it means that Karl was offering to pay a personal debt
with an asset he has since claimed to have belonged to a business in
which he was only a 50% owner at the time, and he did so without the
knowledge or consent of the other "partners."
Of course, Karl did not believe then, nor does he believe now, that
there was as yet a partnership, as no finalized agreement had been
negotiated, and nothing had been signed. This is why he treated your
$5000 as a personal loan to him, as did you, why he never provided me
with any accounting of how he had spent it, since he evidently believed
it was none of my business despite his repeated promises to provide an
accounting, and why he treated any property purchased with any funds
and property in his possession, regardless of the source, as belonging
exclusively to him. If Karl honestly believed that I was his business
partner then don't you suppose he would have informed me of his
situation? He didn't tell me about his eviction, and I didn't even
have his correct address after he moved. What's amazing is that on the
eve of his eviction, after not paying his rent for more than half a
year, Karl was being interviewed by James Smith for that absurd
newspaper article, which described him as an being "poised to go
worldwide." According to Mr. Henderson, after being evicted, Karl
provided the utility company with an invalid forwarding address for his
final bill, and when this came back as undeliverable, problems were
created for Mr. Henderson when he attempted to transfer the service to
his own name.
Since Karl didn't have anything when he approached you and I to invest
in "his" business, I must assume that the "$3000 worth of rough and
equipment" he claimed to have was purchased with the $5000 personal
loan he had obtained from you. In essence, Karl was bringing
absolutely nothing to the table: He had not the credentials nor the
skills, nor the equipment, nor the facilities, nor even the inclination
to fulfill his promises, and if Mr. Roberts' claim is valid, he doesn't
even own Stone of Fire, whatever that is.
(5) Karl wanted me to create for him a Stone of Fire website, even
though he claimed to be a master software developer, and even when he
had months to create his own site beginning on May 1 of this year,
after I transferred the stone-of-fire.com domain to him without even
being reimbursed for the registration fees. He didn't do it and
instead transferred the domain back to me in September. I explained
during many conversations and in writing that I could not produce a
website without content: I needed a bio on Karl, which necessarily
would include details concerning his credentials, programs of study,
degrees and certificates awarded, and other accomplishments, and I also
needed quality graphics, which Karl indicated were being produced by
his friend James Smith. In the weeks before the newspaper article
appeared, Karl assured me that all of the content I needed would be
contained therein, but when it appeared, it most certainly did not.
There was not even a single reference to Karl's college degree or to
his various gemological degrees and certificates, which I found to be
more than suspicious in a personal interest article devoted to a single
"jeweler." Only Karl could provide this content, but just like the
accounting and the steady supply of calibrated stones, he never did.
(6) You were supposed to open a bank account and to establish online
banking arrangements, but you never did these things, and until now my
understanding of why was that no business agreement had been finalized
or signed, and the business entity, the LLC, had not yet been formed.
On the other hand, if you are now conspiring against me with Karl, who
has fraudulently misrepresented his talents, his history, his
credentials, his intentions, and according to others, his assets, then
you will share jointly and severally in his liability for the fraud
that has been perpetrated against me and PriceGems. Before now, I
considered both you and I to be the victims of Karl's fraud, but now it
appears that I have been the mark for the pair of you all along.
(7) There was no agreement between us. If you will look at Karl's
proposed agreement dated September 14, which was still under
development and was never finalized, the proposal which I modified
without response from either of you and to which I suggested additional
modifications both in conference and in writing, you will see there are
places for each of our dated signatures. Obviously, I understood this
to mean that this proposal was simply that, as nothing more than a
draft, and that no binding agreement between us yet existed. Why would
anyone believe otherwise? Why are there places for signatures if it
was not intended that a final agreement would bear our signatures? And
without those signatures, and with difficult, unresolved issues yet on
the table, how could any agreement yet exist? It couldn't because we
hadn't gotten there yet, and by the beginning of October it looked like
we never would. A final agreement would have contained far more
detail and descriptive language than the rough draft hastily composed
by Karl, and it would have included all the necessary and customary
clauses. Before signing, I would have had confirmation of Karl's
contribution, corroboration of his credentials, and I would have the
whole thing reviewed by a competent attorney.
You sent Karl $5000 based at Karl's desperate request, but you did so
without my knowledge or consent, and unadvisedly, in the absence of any
signed, finalized agreement. You even referred to yourself as "stupid"
during our conversation right after the fluff article appeared for
having acted so prematurely. Karl spent your money as he pleased,
without consulting either of us (as far as I know), and when asked
repeatedly in conference calls and in writing for an accounting, none
was ever forthcoming. In fact, none has even been received to date.
When I sensed his break in faith with me at the end of September, I
wrote you to invite your call, and when we spoke, I expressed my grave
concerns and offered you a legitimate means to recover your $5000;
however, after agreeing, you changed your mind some time later, for
this loan you made created a special relationship between you and Karl,
in that Karl was eager to receive his next installment at all costs,
and you were determined to keep Karl placated, even at my expense.
There's so much more, of course, and new reports about Karl continue to
come in from Centralia, such as the as yet unconfirmed report that Karl
has been using the newspaper article he finangled with Smith, along
with your funding ($5,000, $50,000?), to entice new investors, and
that he has been doing this even during the time he now claims to have
had a deal with you and me.
Until now, I have been willing to write off my own losses as a bad
experience and as a lesson learned, for it was such a relief just to
get away from you and Karl, but be advised that if you actually bring
the frivolous suit you have been irresponsibly discussing at your
newest libel lounge, then I will pursue all of my legal options.
Sincerely,
Aaron

In the field of social life those who make the giving of pleasure or pain their object in associating with others have been described; let us now describe those who pursue truth or falsehood alike in words and deeds and in the claims they put forward. The boastful man, then, is thought to be apt to claim the things that bring glory, when he has not got them, or to claim more of them than he has, and the mock-modest man on the other hand to disclaim what he has or belittle it, while the man who observes the mean is one who calls a thing by its own name, being truthful both in life and in word, owning to what he has, and neither more nor less.
Now each of these courses may be adopted either with or without an object. But each man speaks and acts and lives in accordance with his character, if he is not acting for some ulterior object. And falsehood is in itself mean and culpable, and truth noble and worthy of praise. Thus the truthful man is another case of a man who, being in the mean, is worthy of praise, and both forms of untruthful man are culpable, and particularly the boastful man.
Let us discuss them both, but first of all the truthful man. We are not speaking of the man who keeps faith in his agreements, i.e. in the things that pertain to justice or injustice (for this would belong to another virtue), but the man who in the matters in which nothing of this sort is at stake is true both in word and in life because his character is such. But such a man would seem to be as a matter of fact equitable. For the man who loves truth, and is truthful where nothing is at stake, will still more be truthful where something is at stake; he will avoid falsehood as something base, seeing that he avoided it even for its own sake; and such a man is worthy of praise. He inclines rather to understate the truth; for this seems in better taste because exaggerations are wearisome.
He who claims more than he has with no ulterior object is a contemptible sort of fellow (otherwise he would not have delighted in falsehood), but seems futile rather than bad; but if he does it for an object, he who does it for the sake of reputation or honour is (for a boaster) not very much to be blamed, but he who does it for money, or the things that lead to money, is an uglier character (it is not the capacity that makes the boaster, but the purpose; for it is in virtue of his state of character and by being a man of a certain kind that he is boaster); as one man is a liar because he enjoys the lie itself, and another because he desires reputation or gain. Now those who boast for the sake of reputation claim such qualities as will praise or congratulation, but those whose object is gain claim qualities which are of value to one's neighbours and one's lack of which is not easily detected, e.g. the powers of a seer, a sage, or a physician. For this reason it is such things as these that most people claim and boast about; for in them the above-mentioned qualities are found. --Aristotle, The Nichomachean Ethics, IV 7
