I have just got off the phone with a Mr. Maximillian von Wening - “Max” to his friends.

You may not recognise Mr. Wening’s name - but you will all certainly recognise his work:

Mr. Wening has confirmed that ‘thecarwashlive.com’ (and the site’s owner Alan Polonsky) are currently engaged in THEFT of his Intellectual Property by using a scan of his “Grand Prix Carwash” painting as the main logo for TCWL.

Mr. Wening is now reviewing his legal option vis-à-vis choPolonsky.

The “Grand Prix Carwash” painting was commissioned by the owner of the real Grand Prix Carwash - and while Mr. Wening retains intellectual property rights for the painting, it can’t be used on anyone else’s website - for any price.

Mr. von Wening suggests that choPolonsky immediately contact him for discussion about commissioning a custom-made logo for TCWL - and soon. He suggested that the price would be significantly lower if choPolonsky were to contact him BEFORE the lawyers get involved. (I will email choPolonsky Mr. von Wening’s home phone number)

I took the liberty of apprising Mr. von Wening of choPolonsky’s status as a “Rich Hollywood Actor” and I can pretty much guarantee that Mr. von Wening will be pursuing a financial settlement from choPolonsky as a result.

This is the second time he has done this. The very first ezboard version of the cardump used a stolen image as it's banner, too. The owner of the image forced him to remove it. What made that funny was it was during the time when chopo had several threads started, persecuting "intellectual copyright thieves". Oh, how it shamed him so.

chopscriminal has just denied that he was ever forced to remove a cardump banner in the past... Let me guess--he got wind that the owner of the banner was notified of his theft and removed the banner on his own before he was forced to do so... in chopscriminal/liar/manipulator/fraud's mind, this is not lying. Glad we cleared that up.

Once they receive Max's DMCA Notice (which I am drafting for him today) GoDaddy might be more inclined to pull the plug. GoDaddy has ZERO tolerance for Intellectual Property Theft!

choPolonsky is also using the STOLEN image on his eBay ME page - so eBay will also need to be sent one of the DMCA notices.

Complaints to choPolonsky's host should be sent to abuse@godaddy.com

By the way - you all should check out Max's work - he really is a great painter. You can get a print of anything you see on his site. He is also a really nice guy.

I think this thread is a riot. Remember, it was Chops and Nuke who went after Lee/Heavy Metal for months on end, because of his infringement of someone's copyright ... to the extent that it affected just about every single board in the OAI and caused a lot of boards, including boards owned by Chops and Nuke, to be shut down by Ezboard. It also resulted in a lot of people making threats, taking it to real life, bothering law enforcement, and generally making jackasses out of themselves.

But when they do it .... well, that's different, you know. I wouldn't be at all surprised if the current mentality over there considered it a compliment to the owner that his beautiful artwork is being used as the banner on a bash board. I'm sure he would just be thrilled beyond words. :rolleyes:

The collective brain over there has decided that it is only a "copyright violation" if the copyright holder actually complains about the theft ... to the thief.

Not exactly the same standard they were using when they relentlessly targeted Lee (for over a year) for his supposed copyright violations - even though the copyright holder had never - ever - complained ... and still hasn't.

... and they call other people hypocrites? They don't have a clue what the word even means ... or what copyright means either!

The difference here is that the Copyright Holder has confirmed that a crime has been committed. If anyone doubts it - Mr. von Wening's email address and phone number are published on his website (link in the first post) ask him for yourself.

The damages can be reduced by the judge if choPolonsky can convince him that "he didn't know" but with it being discussed on his own board, it will be pretty hard to now convince a judge that he "didn't know" - lol

Hopefully Max won't contact choPolonsky at all - just the attorneys. I gave him choPolonsky's address, so it should be easy to serve him.

This is going to hurt much more than the $10,000 that Nuke stole from him!

Remember when chops denied that he was sanctioned from posting to ebay boards? Remember when he was challenged to post to the ebay boards to prove he was not, but couldn't? If in his demented way of thinking that he can use the "grand prix" photo without violating any laws, there I hereby challenge him to put back the "grand prix" image for a four week period, the "grand prix" image he just removed within the last 12 hours. You can all rest assured that he will have some sort of deranged excuse or some cock-and-bull story as to why he "doesn't want to", you watch and see. Mark my words. Chops will not put back the "grand prix" photo in fear of being sued for thousands, because this is how chops operates. This is the chops style everyone has been accustom to and have witnessed for over half a decade now.

*off for dinner now, but no use in refreshing the dump because "grand prix" wont be posted there again... I assure you.*

I'm lying, they say - but the chickenshit isn't taking any chances because he knows that if he replaces the images after it has been removed - then he will open himself up to huge damages.

I talked to the manager of the real Grand Prix Carwash in Deerfield, IL - and she said that the owners paid THOUSANDS for that painting - and won't be too pleased when they find out it was stolen by online criminals.

They get back from Christmas holidays very soon!
